NOTICE OF PUBLIC HEARING
September Rezoning/Special Use Requests

The Johnston County Board of Commissioners will conduct Rezoning Petition and Special Use Permit Application Public Hearings for the following cases on Tuesday, September 3, 2019 at the 6:00 p.m. Commissioners Meeting in the Commissioners Meeting Room, Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina.  After each rezoning case is heard, the rezoning public hearing, which is a legislative hearing, will be recessed and the Board will render a decision.  In the case of special use district rezonings, the special use hearing will be heard before reopening the hearing for the next case.  The special use hearing is a quasi-judicial hearing where the Board is sitting as judges and will hear factual evidence as testimony.

CASE 460-MOD: Rezoning Petition: Petition to modify special use of 1.01 acres located at 11268 NC Hwy 210 in Elevation Township currently zoned Industrial 2-Special Use District (I2-SUD).  Tax ID: 07F06032E  Owner: Lloyd & Lisa Glover   Applicant: Lloyd & Lisa Glover
Special Use Permit: Petition to modify special use to clarify operating hours, increase maximum allowed vehicles on premises, and change storage requirements.

Notice of Intent to Consider Adoption of Resolution
Johnston County Board of Commissioners

Notice is hereby given that the Johnston County Board of Commissioners, pursuant to NCGS § 160A-280, intends to consider adoption of the following resolution at their Tuesday, September 3, 2019 10:00 a.m. regular meeting held in the Commissioners Meeting Room located in the Johnston County Courthouse at 207 E. Johnston Street, Smithfield, North Carolina: 

Resolution Approving Conveyance of Personal Property to
A Nonprofit Organization
Pursuant to G.S. 160A-278

WHEREAS, the County of Johnston (“County”) owns a 2009 Ford Ambulance, VIN# 1FDXE45P79DA24861, Fleet #133/Asset #14194 which was utilized by Four Oaks Rescue Squad, Inc. for the provision of emergency medical services within Johnston County; and

WHEREAS, North Carolina General Statute § 160A-280 authorizes a county to convey personal property for nonmonetary consideration to a nonprofit corporation if the governing board deems the property to be surplus, obsolete, or unused; and

WHEREAS, the County of Johnston has determined that the personal property described above is surplus, obsolete, or unused; and

WHEREAS, the County of Johnston finds that the public will benefit from the conveyance of the property described above by assisting the nonprofit with the replacement of equipment necessary to provide emergency services to Johnston County citizens.

THEREFORE, THE JOHNSTON COUNTY BOARD OF COMMISSIONERS RESOLVES THAT:

  1. The manager and/or finance officer of Johnston County is authorized to execute all documents necessary to convey title to a 2009 Ford Ambulance, VIN# 1FDXE45P79DA24861, Fleet #133/Asset #14194 to Four Oaks Rescue Squad, Inc. 
  1. The consideration for the conveyance is the public benefit from the conveyance of the property described above by assisting Four Oaks Rescue Squad, Inc. with the replacement of equipment necessary to provide emergency services to Johnston County. 
  1. In accordance with the notice requirements of N.C.G.S. § 160A-280, public notice of this resolution was given by posting on the county’s website on August 12, 2019.

OCTOBER APPOINTMENTS

The Johnston County Board of Commissioners will be considering the following upcoming appointments.   Please note the deadline to apply is September 24, 2019.  Applicants must be a resident of Johnston County. 

Alcoholic Beverage Control Board – 1 position; 3 year term 

Child Fatality Prevention Team – 5 positions; 3 year terms (One position representing a local law enforcement officer, one position representing an emergency medical services provider or firefighter; one position representing a parent of a child who died before reaching their 18th birthday; and two positions representing a county agency or the community at-large.)

Firefighter’s Relief Fund Boards of Trustees – 2 year terms.  (One position representing each of the following Fire Districts: Archer Lodge, Bentonville, Beulah, Blackman’s Crossroads, Boon Hill, Brogden, Corinth-Holder, Elevation, 50/210, McLemore, Meadow, Micro, O’Neals, PI-LE, Shoeheel, Strickland’s Crossroads, Thanksgiving, West Johnston, Wilson’s Mills and Wynn – Applicants must reside within the district they apply for.)

Heritage Commission – 8 positions; 2 year terms

Johnston County Tourism Authority – 1 position; 3 year term. (Applicants must be an owner or operator of a hotel, motel, or other taxable tourist accommodation.)

Local Emergency Planning Commission – 6 positions; 2 year terms (Applicants must be able to represent one of the following areas of interest:  State or Local Elected Official; Law Enforcement; Media - Television, Print, or Radio; and Community Groups) 

Moccasin Creek Service District Board – 2 positions; 2 year terms (One position representing the Town of Pine Level and one position representing the Rural Area of the District.  Applicants must reside or own real property in the District and be a resident of Johnston County.  Pine Level applicants will be forwarded to the Pine Level Town Council for a recommendation.)

Newton Grove Fire Protection District Commission – 1 position; 2 year term (Applicants must reside within the Newton Grove Fire District and be a resident of Johnston County). 

Nursing Home/Adult Care Home Community Advisory Board – 11 positions; 1 year term for new appointees or 3 year term for reappointed members.  “No person or immediate family member of a person with a financial interest in a home served by a committee, or an employee or governing board member of a home served by a committee, or immediate family member of a patient in a home served by a committee may be a member of a committee.”

Voluntary Agricultural District Advisory Board - 1 position; 3 year term (Applicants must be actively engaged in farming and meet the eligibility criteria for the Johnston County Voluntary Agricultural District Program and/or express special interest, experience or education in agricultural and/or land preservation.)
