The Johnston County Board of Commissioners will conduct Rezoning Petition and Special Use Permit Application Public Hearings for the following cases on Monday, April 3, 2017 at the 6:00 p.m. Commissioners Meeting in the Commissioners Meeting Room, Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina. After each rezoning case is heard, the rezoning public hearing, which is a legislative hearing, will be recessed and the Board will render a decision. In the case of special use district rezonings, the special use hearing will be heard before reopening the hearing for the next case. The special use hearing is a quasi-judicial hearing where the Board is sitting as judges and will hear factual evidence as testimony.

The Chairman of the Johnston County Board of Commissioners has called for a public hearing on Monday, April 3, 2017, at the 10:00 a.m. regular meeting of the Johnston County Board of Commissioners held in the Commissioners’ Meeting Room, Johnston County Courthouse, 207 E. Johnston Street, Smithfield, NC 27577. The public hearing will begin immediately following the Public Comment section held at the beginning of the meeting (10:00 a.m.), or as soon thereafter as possible.
Johnston County intends to amend an existing economic development grant agreement with a company that expanded and constructed production facilities in Johnston County and hired a substantial number of new, permanent full-time employees to work there. The County believes the amended Economic Development Agreement will help stimulate the local economy, promote business, result in new taxable capital investments and investment opportunities within the County, and retain employment in the County. The Board of Commissioners will solicit public comment on the proposed incentives at the public hearing. It is the preliminary intention of the Board of Commissioners to approve the grant of these incentives to the company in exchange for the company’s commitments to retain a substantial number of permanent full-time jobs. The permanent full-time jobs and investment in taxable real property improvements and business personal property additions will return property tax revenues substantially in excess of the County’s investment. The cash grants are contingent upon, among other things, the company’s entry into an amended local economic development agreement with the County containing the amended obligations and agreements of the company and the County. All interested persons are invited to attend and present their views during this public hearing.

NOTICE IS HEREBY GIVEN that the Board of County Commissioners (the “Board”) of the County of Johnston, North Carolina (the “County”), will conduct a public hearing on April 3, 2017 concerning a proposed plan of refinancing of all or a portion of one or more existing installment financing contracts previously executed and delivered by the County (the “Prior Contracts”), which Prior Contracts paid all or a portion of the costs of acquiring, constructing and equipping various public facilities and related improvements and costs (collectively, the “Projects”).
The proposed plan of refinancing would involve the entry by the County into one or more installment financing contracts (the “Refunding Contracts”) with one or more third parties in an aggregate principal amount not exceeding $22,400,000; and the proceeds of the Refunding Contracts would be used to refinance all or a portion of one or more of the Prior Contracts and the Projects.
The obligations of the County under the Refunding Contracts are authorized by North Carolina General Statutes Section 160A-20, as amended, and will be secured by a lien on or a security interest in all or some portion of the Projects financed by the Prior Contracts and/or in all or some portion of the real property on which such Projects are located.
The obligations of the County under the Refunding Contracts will not be deemed to be a pledge of the faith and credit of the County within the meaning of any constitutional debt limitation and the Refunding Contracts will not directly or indirectly or contingently obligate the County to make any payments beyond those appropriated in the sole discretion of the County for any fiscal year in which the Refunding Contracts are in effect. No deficiency judgment may be rendered against the County in any action for breach of the Refunding Contracts and the taxing power of the County is not and may not be pledged directly or indirectly or contingently to secure any moneys due under the Refunding Contracts.
